Gratuity in the UAE is calculated based on your last basic monthly salary, length of service, and the type of contract (limited or unlimited). The gratuity amount increases the longer you’ve served and differs depending on whether you resign or are terminated.

The standard gratuity formula is:

21 days of basic salary per year for the first five years of service
30 days of basic salary per year for every year after five years

Example: (21 or 30) ÷ 30 × monthly basic salary × years of service

Prorated amounts apply if service duration includes additional months and days.

The 2025 UAE Labour Law continues to enforce the rules under Federal Decree-Law No. 33 of 2021, with emphasis on:


– Standardised contract types
– Equal treatment and non-discrimination
– End-of-service benefits for all workers
– Flexible working models (remote work, part-time, etc.)

The Ministry of Human Resources and Emiratisation (MOHRE) regularly publishes any updates. Our calculator reflects the most recent rules.

As per the UAE Labour Law Federal Decree-Law No. 33 of 2021, in effect from February 2022, the key changes include:


– Gratuity applies to all contract types (limited contracts only, now unlimited also applies).
– Calculation is now based on working days (not calendar days).
– No gratuity deductions unless specified by law (e.g. if an employee resigns before 1 year, no gratuity is due).

These rules continue to apply in 2025 unless amended by cabinet resolution.

For gratuity purposes, the salary is calculated based on 30 days, regardless of the actual number of days in a month. This standardisation helps ensure fair and consistent end-of-service benefit calculations across companies.

The maximum notice period allowed by UAE Labour Law is 3 months, unless otherwise agreed in writing. During this period, both employer and employee must uphold full duties (including salary, benefits, and working hours).


If either party fails to honour the notice, compensation equal to the notice period salary may be legally due.
