Recently, we have handled matters in the Courts of the UAE, advising on issues including:
- A case before a Dubai Court wherein the Court had to determine whether a contract made for compliance with the requirements of DED (Dubai Economic Department) was enforceable when there was clear factual evidence suggesting that there was a separate contract reflecting the actual terms agreed between the parties.
- A case before a Dubai Court where the Court had to determine whether a company could be impleaded in a case even when its sister company was the entity that was signatory to the contract, which was the subject of the dispute.
- A case before Dubai Court related to a construction dispute for claims for outstanding payment, variations and prolongation costs.
- A case before Dubai Court where the Court had to determine whether an arbitration award could be set aside because the persons who signed the agreement containing the arbitration clause did not have the specific authority to bind their respective companies to an arbitration agreement.
- A case before Sharjah Court where the Tenant claimed refund of unutilised rent related to a Tenancy Contract that was not registered with the Sharjah Municipality and as such could not be adjudicated by the Sharjah Rental Dispute Committee.
